  38. Disability shall be defined as a substantial impairment of my 
  39. ability to care for my property by reason of age, illness, 
  40. infirmity, mental weakness, intemperance or addiction to drugs.  
  41. For the purpose of the exercise of this power by my attorney in 
  42. fact, my disability shall be conclusively determined by any one 
  43. of the following:

  45.     (a)  The filing of a petition in a court of law personally by 
  46. me to appoint a guardian of my person or estate,
  47.  
  48.     (b)  A written declaration of my disability by my personal 
  49. physician, {PHYSICIAN_NAME}, to me and my attorney, or
  50.  
  51.     (c)  A written declaration of my disability by me to my 
  52. attorney in fact.

  54. If the above-named physician shall die, cease to practice in 
  55. {COUNTY_NAME} County, {STATE_NAME} or fail to render a written 
  56. opinion as to my disability within a reasonable time upon a 
  57. request of the person named herein as my attorney in fact, then I 
  58. request that the governing board of the {COUNTY_NAME} County 
  59. Medical Society (or an equivalent or successor organization) 
  60. appoint three (3) physicians from the County to conduct an 
  61. examination into my disability.  This committee is authorized to 
  62. rely solely upon written evidence in determining whether I am

  64. to my attorney in fact and such findings shall conclusively 
  65. determine my disability, or absence thereof.  Members of the 
  66. committee shall be entitled to reasonable compensation for their

  82. attorney from causing him, or her, from being taxed on my income 
  83. (unless said attorney in fact is my spouse) or from causing my 
  84. assets to be subject to a general power of appointment by my said 
  85. attorney, as that term is defined in the Internal Revenue Code of 
  86. the United States or similar laws of other jurisdictions.

  89. {!GP}.  Indemnification of Attorney in Fact.  I hereby bind 
  90. myself, my heirs, devisees and personal representatives to 
  91. indemnify my attorney in fact and any successor attorney in fact 
  92. against any and all claims, demands, losses, damages, actions and 
  93. including expenses, costs and attorneys' fees that he, or she, 
  94. may sustain or incur in exercising the power of attorney.  My 
  95. death shall not revoke or terminate this agency as to any 
  96. attorney in fact who, without actual knowledge thereof, acts in 
  97. good faith under this power of attorney.  Any action so taken, 
  98. unless otherwise invalid or unenforceable, shall be binding upon 
  99. me and my heirs, devisees and personal representatives.  An 
  100. affidavit executed by my attorney in fact, or a successor 
  101. attorney in fact, stating that he, or she, does not have, at the 
  102. time of doing an act pursuant to this power of attorney, actual 
  103. knowledge of its revocation or termination is, in the absence of 
  104. fraud, conclusive proof of the continued existence of the power 
  105. at that time.
